Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to prosecution version the applicant is not named in the F.I.R. He has not been put up for identification. The only allegation against him is that from his possession a sum of Rs. 10,500/- has been recovered. The recovered currency were not bearing any specific mark to show that the it was looted property. The recovery was not supported by any public witness. The applicant is in jail since 7.3.2006
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Vikrant Chaudhari @ Deepu involved in Case Crime No. 23 of 2006, under Sections 395, 397 and 412 I.P.C., Police Station Phugana District Muzaffarnagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
