This writ petition has been filed for quashing the order dated 2.5.1997 by which the licence of the petitioner's Sawmill has been cancelled and the order dated 22.12.2005 by which the renewal application has been rejected. .
Learned Standing Counsel has submitted that as licence has been cancelled vide order dated 2.5.1997, the application for renewal was not maintainable and it would be appropriate that the petitioner may file a fresh application for grant of licence. Learned Standing Counsel has also assured the Court that as the issue dealing with all legal and factual averments had already been decided in Chaudhary Chandan Singh Vs. State of U.P. & Ors., AIR 2005 Alld. 280, therefore, petition may be disposed of directing the respondent No.1 to consider the application of the petitioner for the grant of licence of the Sawmill in accordance with the said judgment. .
In view of the submissions made by the learned Standing Counsel, we dispose of this petition directing the respondent No.1 to consider the application of the petitioner for the grant of the licence of the Sawmill in the light of the directions issued by this Court in the aforesaid case expeditiously preferably within a period of two months from the date of filing of a certified copy of this order along with a photostat copy of the said judgment by the petitioner before respondent No.1.
