The petitioner's licence was suspended on 17.11.2005. He was given charge sheet and subsequently his license had been canceled on 28.12.2005. Against this order he has filed an appeal which is pending before the respondent no.2. During the pendency of the appeal the respondent no. 3 had passed an order on 28.1.2006 requiring the Gabon Saba to make proposal for appointment of fair price shop licensee of the shops which are vacant, hence the present writ petition.
We have heard the counsel for the petitioner and Standing Counsel for the respondents.
The petitioner has already filed an appeal against the order canceling the license. In case the petitioner is aggrieved by any other order, he may file an application for interim order in his appeal . The appeal may also be decided by the respondent no.2 according to length of pendency of appeals before him.
With these observations the writ petition is disposed of.
