Sri L.P.Tiwari learned counsel for the landlord respondent states that landlord has sold the property to some other person hence he is no more interested in the property in dispute. Learned counsel further states that the purchasers filed suit for eviction against tenant petitioner being SCC Suit No. 76 of 1986, Ram Kanwal Singh Versus Surjan Singh which was dismissed on 23.1.1988 by the JSCC, Gorakhpur.

Learned counsel for the applicant petitioner states that writ petition has become infructuous hence he does not want to press this restoration application.

Accordingly restoration application is dismissed as infructuous.
