It is stated on behalf of the petitioner that in the writ petitions, details whereof has been furnished in paragraph 5 and 6 to the present writ petition, the present petitioner was not a party and he has not approached this Court earlier for regularization of his services.
It is further submitted that the claim of the petitioner for regularization is not being considered on the ground that the petitioner has not passed High School Examination, despite the fact that the petitioner has put in a long length of service as daily wage employee in the Forest Department of the State of U.P.. Petitioner seeks protection of the provisions of the U.P. Regularization of Daily Wages Appointments of Group 'D' Post Rules, 2001 and in that regard the petitioner has already made a representation dated 27th December, 2005, which is pending consideration before the respondent no. 3. It is further stated that the claim of other similarly situate candidates is scheduled to be considered on 17th January, 2006.
In the facts and circumstances of the case, it would be in the interest of justice to direct the respondent no. 3 to consider the claim of the petitioner along with other similarly situate candidates at the earliest possible in accordance with law as also in view of the judgment of this Court in the case of Sanjay Srivastava vs. State of U.P., Writ Petition No. 48322 of 2001 decided on 17th October, 2005, if possible on 17.1.2006 and in any case within four weeks from the date a certified copy of this order is filed before him. It is ordered accordingly.
Writ petition stands disposed of.
