This  is a writ petition  for  quashing the   order dated  21.2.2006 and  for directing the respondents not to interfere with the  realisation of   octroi .

We have heard  the  counsel for the petitioner and  Standing Counsel for the respondents.

According  to the counsel for the  petitioner  some money has already been  waived  by the Board  and he is willing to pay  the remaining  amount and he   should  be permitted  to function.

In the circumstances of the case , the petitioner may  file a representation  before the respondent no.3 In case the representation is filed it may be decided  by the  concerned authority  by a reasoned order at an early date,  if possible, within   one   month  from the date of receipt of representation . The petitioner   will  file  a certified copy of this order; necessary  documents and a duly stamped self addressed envelope alongwith the representation. The concerned   authority   after taking   decision will  communicate the same to the petitioner.

With these observations the writ petition is  disposed of.
