Heard learned counsel for the parties and perused the record.  

The petitioner-committee of management runs an institution by the name and style of Sahayog Sanskrit Uttar Madhdyamik Vidyalaya, Jhunsi, Allahabad. The grievance of the petitioner is that it had submitted 20 forms with the respondents for Purva Madhyama Ist and IInd year and Uttar Madhyama Ist and IInd year Examinations conducted by the respondent-authorities for the academic session 2004-05. Shri Hanuman Inter College, Lahurpur, Hanumanganj, Allahabad was allotted as the examination centre for the students of the petitioner-institution. The result of the examination has been declared in the month of July, 2005 for the entire State except the students who submitted their forms through the petitioner-institution and two other institutions.

When the petitioner perused the matter, the District Inspector of Schools, Allahabad, respondent no. 3, submitted a report to the Secretary Uttar Pradesh Sanskrit Madhyamik Shiksha Parishad, Lucknow, respondent no. 1, vide Annexure 3 to the writ petition. It appears that in the mean-time the Deputy Inspector of Sanskrit Pathshalas, respondent no. 4, made certain queries from the petitioner vide letter dated 13.12.2005 (Annexure 4 to the writ petition). The petitioner in compliance with the aforesaid letter dated 13.12.2005 furnished the requisite information to respondent no. 4 vide Annexure 5 to the writ petition accompanied by an affidavit duly signed by the Manager Sri Ranjan Srivastava with the request to declare the result of those 20 students who submitted their forms through the petitioner-institution. It is alleged that the result of other two institutions has been declared but till date neither the result of the petitioner-institution has been declared nor the students are being allowed to appear in the next examination to be commended from 25.4.2006.

When the efforts of the petitioner met with no fruitful result, the present writ petition has been filed with the following prayers: -

"(i) issue a writ, order or direction in the nature of mandamus commanding the respondents to declare the result for Purva Madhyama first and second year for the session 2004-2005 and result for Uttar Madhyama first and second year for the session 2004-2005 forthwith.

(ii) issue a writ, order or direction in the nature of mandamus commanding the respondents to allow the students of petitioner's institution to appear in the next examination going to be started w.e.f. 25.4.2006.

(iii) issue any writ, order or direction which may be deemed fit and proper under the circumstances of the present case.

(iv) award costs of this petition to the petitioner."

On 21.4.2006 this Court had directed the learned Standing Counsel to seek instructions in respect of declaration of result of the students who submitted their forms for Purva Madhyama Ist and IInd year and Uttar Madhyama Ist and IInd year Examinations through the petitioner-institution for the academic session 2004-05.

In compliance of the aforesaid order the learned Standing Counsel has produced the letter/report dated 22.4.2006 of the Secretary Uttar Pradesh Sanskrit Madhyamik Shiksha Parishad, Lucknow wherein it has been stated:

Shri M.M.Sahai, learned counsel for the petitioner, has drawn the attention of the Court to letter dated 24.12.2004 contained in Annexure 1 to the writ petition stating that the students had submitted their forms after depositing the requisite fee vide Bank Draft No. 963976 dated 1.12.2004 in favour of the Secretary, Secondary Sanskrit Education Board, Lucknow. From a perusal of Annexure 2 to the writ petition it appears that the result of the students of two other institutions also along with the students of petitioner-institution had not been declared.

It also appears from a perusal of letter dated 20.12.2005 from the Deputy Inspector of Sanskrit Pathshalas, Allahabad Mandal, Allahabad to the Secretary, U.P. Sanskrit Madhyamik Shiksha Parishad appended as Annexure 7 to the writ petition that the petitioner-institution had completed all the formalities in time. The District Inspector of Schools, Allahabad had also vide its letter dated 11.11.2005 contained in Annexure 3 to the writ petition submitted its report recommending for declaration of result of the petitioner-institution.

It is apparent from the perusal of the instructions sent by the respondents that they are based on incorrect facts. The centre Shri Hanuman Inter College, Lahurpur, Hanumanganj, Allahabad has been debarred and though fee having been paid and all formalities having been completed by the petitioner the result of the students of the petitioner-college is not being declared merely because the centre incharge of Shri Hanuman Inter College, Lahurpur, Hanumanganj, Allahabad was demanding money and has been black listed as it has not sent the attendance sheet to the Secretary, Secondary Sanskrit Education Board, Lucknow.

Prima-facie a case for interim mandamus is made out as the next examination of Purva Madhyama Ist and IInd year and Uttar madhyama Ist and IInd Year are to commence from 25.4.2006.

In the circumstances, the respondents are directed to permit the students belonging to the petitioner-institution to appear in the Purva Madhyama Ist and IInd year and Uttar madhyama Ist and IInd Year Examination scheduled to commence from 25.4.2006. The institution will deposit all requisite fee before the appropriate authority within seven days from today. However, till further orders of the Court, the result of the students belonging to the petitioner-institution shall not be declared.

The Secretary, Uttar Pradesh Sanskrit Madhyamik Shiksha Parishad, Lucknow (respondent no. 1) will file her personal counter affidavit within two weeks. The learned counsel for the petitioner shall file his rejoinder affidavit within one week thereafter.

List this case for 16th May 2006.

The Secretary, respondent no. 1, shall also be personally present in Court on the date fixed along with all relevant record so that the controversy is resolved and appropriate orders may be passed regarding publication of the result.

Let a certified copy of this order be issued today to the learned counsel for the parties on payment of requisite fee.
