1.We have heard learned counsel for the petitioners and Sri J.K.Tewari learned standing counsel appearing for the respondents in the writ petitions numbered above.

2.After hearing the grouses of the petitioners in the aforenoted writ petitions and the learned  Standing Counsel we are dismayed with the picture emerged before us. What appears that the Rules of fixing seniority, the period in which one should be promoted, transfer and posting framed by the State are not being applied in their right perspective and in uniformity, one for all and sundry. The aforenoted writ petitions before us raise all these questions stated above and pray for their redressal. We need not reproduce all those grievances of the petitioners verbatim, but we deem it advisable that directions be issued to the respondents in that regard which will apply to all the doctors functioning in the State of U.P. and which shall be complied by the respondents by 15th June, 2006 and we fervently hope that the respondents by applying these directions in the cases of the petitioners as per their requirements will give the petitioners relief as far as possible. During the course of hearing we were informed by the counsel for the petitioners and the officers that long stay of doctors in one district lucrates their private practice which is prohibited by their service rules and as such doctors do not punctually attend their duties. These orders as such are issued in larger public interest. The respondents Principal Secretary, Medical Health and Director General, Medical Health Services will thereafter file an affidavit before us with regard to the compliance made in regard to all these writ petitions. Affidavit will be filed in the leading Writ Petition No.72523 of 2005 on the following points:-

i. The doctors, who have completed 10 years of tenure in a district

in their service career, are to be transferred outside the district at least 100 kms. Away therefrom. They will not be transferred back to that district unless they complete five years tenure of service in any other district. It is made clear that if a new district has been carved out and a doctor has been posted there and earlier to it he was posted in the parent district, both these tenures will be counted to hold his service tenure in that district of ten years and such doctors will also be transferred from that district.

ii. Level-I and Level-II doctors not functioning on a cadre post or working under attachment in any district hospital be also transferred to P.H.Cs/C.H.Cs. No doctor of level-I and Level-II be attached at any place except his place of original posting. No doctor of Level I and Level II should be posted on zero posting and if any such doctor is working of zero posting, he shall immediately be relieved.

iii. The doctors who are in specialized cadre possessing the degree of post graduation, as far as possible, be posted in the District Government Hospitals where the posts of their specialty are sanctioned, than those specialized doctors who hold diploma in any specialty.

iv. Promotions be made in specialized cadre, male or female on all levels by 15.6.2006.

v. Anomaly of functioning of a senior doctor under a junior doctor, which gives frustration, should be removed. No senior doctor should be posted under a junior doctor.

vi. The doctors who are likely to retire within one year from the date of their transfer will not be transferred from the district they are working unless they opt for it, and maximum endevour should be to post them in the district they want to settled down after retirement in State of U.P.

vii. The husband and wife be accommodated, as far as possible, in the same hospital and if not possible atleast in the same district.

viii. It should be noted in the public interest that functioning of a District Hospital is not possible unless the young doctors are there. Therefore, level I and level II doctors are needed there for   functioning, which, in presence of prevalent policy is not possible unless some more posts are created to post level I and level II doctors in the district hospitals. Principal Secretary and the Director General of Health will make an endevour to cater this need according to the size and requirement of district hospitals because all the Chief Medical Superintendents appearing before us on our query have pointedly expressed that these doctors are the backbone of the emergency duties and to render assistance to the senior doctors an d specialists in odd time.

ix. A doctor being transferred from a place should be replaced by his incumbent. The Chief Medical Officers/Chief Medical Superintendents will ensure enforcement and compliance of the

transfer order by relieving and getting joined the doctor under transfer, as the case may be.

x. The new appointees shall be posted in PHCs/CHCs initially for a period of five years.

xi. Guidelines noted above with regard to attachment and posting will stand relaxed in the emergent situations viz. Epidemic or spreading of any disease in any area.

xii. Machines like CT Scan, Ultra Sound, Pathologies etc. in the hospitals must be manned by the trained doctors and the earnest effort must be made to ensure that no pathology or machine remains lying unutilized in absence of an expert.

xiii. The compliance of the above guidelines be ensured by   15.6.2006 so that the doctors transferred may take their new assignment without any difficulty to their children.

xiv. If any doctor has not worked in any rural area, then he should be placed at CHC/PHC, as the case may be, for a period of three years and this aspect shall always be taken into account while making transfer, posting or promotion.

List on 11.7.2006. The Principal Secretary, Medical and Health and Director General, Medical Health Services, U.P., Lucknow shall file their affidavit of compliance of the order failing which they shall be personally present in the court on the aforesaid date.

The office is directed to hand over a copy of this order to Shri J.K.Tewari, learned standing counsel for onward transmission and compliance of this order.
