Heard Sri R. K. Sinha, learned counsel for the petitioners, Sri Mohd. A. Ansari, learned counsel for the informant, learned A.G.A. and perused the record.
Supplementary affidavit filed today be taken on record.
It is contended by learned counsel for the petitioners that petitioners no. 3 and 4 are students of B.A. and their examinations are to commence in the month of May and in this regard he has filed the documents as annexure nos. 1, 2 and 3 to the supplementary affidavit.
Considering the facts and circumstances of the case, the writ petition of petitioner nos. 1 and 2 is liable to be dismissed and is hereby dismissed. However in case they put in appearance before the Courts below and make an application for bail in Case Crime No. 93 of 2006 under Section 364 IPC, P.S. Gangoh, District Saharanpur, their bail application shall be disposed of as expeditiously as may be convenient in accordance with law.
In case of petitioners no. 3 and 4, if the investigation in above noted Case Crime has not been concluded, the same shall be concluded within a period of three months from the date of presentation of the certified copy of this order but the arrest of the petitioner nos. 3 and 4 shall not be effected till then, provided they cooperate with the investigation.
The writ petition as regards the petitioner nos. 3 and 4 stands disposed accordingly.
