1. This is a writ petition for quashing of the order granting fair price shop to respondents no. 5 and 6.
2. We have heard counsel for petitioner and Standing counsel for the respondents. The counsel for the petitioner submitted that according to the GO on the point, out of two shops, one shop was to be allotted to a person of reserved category and the petitioner being an ex-army man and a member of OBC was entitled to benefit of this reservation; and so both the shops could not be given to respondents 5 and 6 who are person of general category.
3. In the circumstances of the case, the petitioner may file a representation before respondent no. 2. In case the representation is filed, it may be decided by respondent no.2 by a speaking order, if possible, within three months from the date of receipt of the representation. Respondent no. 2 while passing any order will also give opportunity to respondents 4 to 6. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self-addressed envelope along with his representation. Respondent no.2 after taking decision will communicate the same to the petitioner.
4. With these directions the writ petition is disposed of.
