Heard learned counsel for the parties and perused the record.
The grievance of the petitioner is that neither the result of his back paper of LL.M. Part I Examination is being declared nor his representation made in this regard is being decided by the University authorities.
In pursuance of order dated 21.4.2006 Attendance Sheet of the Examination held on 21.5.2005 has been produced by the respondent showing that the petitioner was present in the last paper no. 667-A General Principal of Law of Torts and it has wrongly been stated that the petitioner was not present in that paper.
Sri Prakash Padia, learned counsel for the respondent-university states that the petitioner shall be given average marks in the aforesaid paper of 667-A General Principles of Law of Torts as the answer books have already been weeded out. The learned counsel for the petitioner has no objection for being given average marks on the basis of his performance in paper no. 667-A, General Principles of Law of Torts of the aforesaid LL.M. Part I Examination.
Admittedly the petitioner has deposited Rs. 16,000/-. Average marks as well as correct marks shall be given to the petitioner within one month only on the condition that the petitioner deposits the difference of fee amounting to Rs. 23,000/- within one month in addition to the fee for Examination Forms etc.
With the aforesaid directions the petition is disposed of.
