This writ petition has been filed for deciding the application dated 19.12.2005 (Paper No. 14 C).

We have heard learned counsel for the petitioner and have perused the material available on record.

In the facts and circumstances of the case, we are satisfied that the petitioner has made out a case for issuance of such a direction. We, therefore, direct the Additional Civil Judge (Senior Division) Aligarh to decide the application dated 19.12.2005 (Paper No. 14 C) expeditiously giving strict adherence to the provisions of Order XVII Rule 1 of the Code of Civil Procedure.

Subject to the aforesaid observations, the writ petition is disposed of.
