Heard learned counsel for the petitioner and perused the record.
The transfer application of the petitioner has been rejected by the learned District Judge, Kaushambi on 31.3.2006. On perusal of the transfer application, filed by the petitioner, it appears that the transfer has been sought mainly on the ground that during the course of the arguments, the learned Judge had expressed his view. There is nothing unusual about the same as during the course of arguments, while posing questions to the counsel, the Judge expresses his tentative view only to further cause of justice so that the counsel can give his reply. On such ground if it is apprehended that the court would not give justice to the parties, then in every case parties would start moving application for transfer. Accordingly, in my view, the transfer application has rightly been rejected. No interference is called for.
This writ petition is dismissed. No order as to costs.
