It is vehemently contended that the petitioner retired on 31st December, 2004 but till date post retiral benefits including pension has not been given to the petitioner on the pretext that some enquiry is pending.
Learned counsel for the petitioner submits that till date neither any charge sheet has been served nor the petitioner has been informed about the pendency of any such enquiry.
Learned Standing Counsel appearing for the State-respondents prays for and is allowed three weeks time to seek instructions in the matter and file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter. List thereafter.
In the meanwhile, it would be open to the respondents to pay the post retiral benefits to the petitioner in accordance with law provided there is no legal impediment.
