Heard Sri Pankaj Srivastava on his two applications one for the recall of the order dated 17.2.2006 and secondly that Ram Bilas has been released on bail during the pendency of the revision.
I have heard learned A.G.A. Also and gone through the record.
The revision was taken up on 17.2.2006 when neither the counsel for the revisionist nor the sole surviving revisionist Ram Bilas was present. The revision was filed in 1987. The judgment of conviction was affirmed by learned Sessions Judge. Having considered the pendency of the revision from, 19 years and unwillingness of the learned counsel for the revisionist to argue the revision, the order dated 17.2.2006 was passed.
Sri Pankaj Srivastava Advocate contended that in the cause list his name was printed as P. Srivastava instead of Pankaj Srivastava, therefore, he could not infer that he was counsel in the said case and therefore, could not appear in the Court on the said date. An affidavit of the same effect is filed by himself. Relying upon the affidavit of Sri Pankaj Srivastava I deem it proper to recall my order dated 17.2.2006.
It is stated in the affidavit filed in support of the application that Ram Bilas was arrested on 7.4.2006. Ram Bilas revisionist be released on bail on his executing a personal bond of Rs.30000/- and two sureties in the like amount to the satisfaction of C.M.M. Kanpur Nagar. After the bail bonds or personal bond are furnished , a photo copy of the same be sent to this Court within a month.
The revision is pending from 1987. Therefore, it is desirable that it will be listed at the earliest for its disposal.
