The C.J.M. Deoria has sent compliance report regarding death of respondent no.3 Jagoo son of Chingi. On the basis of the statement of Smt. Subhawati Devi, Addl.Gram Pradhan of village Taryasujan and the statement of Kailash Nath Yadav Panchayat Vikas Adhikari, verified that the respondent no.3 Jagoo has died about 15 years back.
Relying upon the report of the C.J.M. The case against respondent Jagoo stands abated.
None appears for the remaining appellant Nathoo and Bhagel even on the revision of the list. Issue non bailable warrant against appellants no.1 and 2 if those appellants applies for bail after his surrender or arrest, the C.J.M. Deoria shall release them on furnishing of personal bonds or bail bonds amounting to Rs.30000/- and two sureties of the like amount. A photo copy of the personal bonds or bail bonds be sent to this court by C.J.M. Deoria within two months.
