This writ petition has been filed raising the grievance that respondent no. 4 has been given the contract even though he had not submitted the tenders in pursuance of the tender inviting notice, but three persons, including the petitioner, who had submitted their tenders have illegally been ignored. A prayer has, therefore, been made that the contract in favour of the respondent no. 4 should be cancelled.
Shri M.K. Kushwaha, learned counsel appearing for the respondent Department has submitted that the contract awarded to respondent no. 4 had been cancelled vide letter dated 7.3.2006. Shri Kushwaha has further made a statement that a press notice shall now be published inviting all the eligible persons, including the petitioner, who would be at liberty to submit their tenders and a decision would be taken in accordance with law.
In view of the submissions made by Shri Kushwaha, the petition is dismissed as having become infructuous. However, the respondents are directed to award the contract by inviting fresh tenders and proceed in accordance with law.
