This is an  application for bail moved on behalf of the applicant Pooran Lal                              indicted in case crime No. 273  of 2005 under sections 302, 323, 201  I.P.C. and 3 (2)(5) S.C./S.T. Act P.S. Khudaganj District Shahjahanpur.

Heard Shri P.N. Gangwar, learned counsel for the applicant, Shri Radhey Shyam Shukla, learned counsel for the complainant, learned A.G.A.  and have perused the record.

      On 28.9.2005 at about 10.30 A.M. the co-accused is said to have mounted  murderous assault on the brother of the complainant whereas the applicant caught hold of the victim.

      Learned A.G.A. submitted that the applicant facilitated the commission of murder by catching hold of the victim.Learned counsel submitted that the applicant restricted   the movement of the victim by catching hold of him.

      I have taken into consideration the submissions raised on behalf of both the parties.

      The role of catching hold of the victim having been assigned to the applicant, I consider it to be a fit case for grant of bail.

Let the applicant Pooran Lal                              indicted in case crime No. 273 of 2005 under sections 302, 323, 201 I.P.C. and 3 (2)(5) S.C./S.T. Act P.S. Khudaganj District Shahjahanpur,be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
