Heard learned counsel for petitioner, learned counsel for Caveator as well as learned Standing Counsel and perused the record.
From perusal of the record, it transpires that order dated 12th May, 2001, passed by Assistant Consolidation Officer was set aside by the Appellate authority by an order dated 21st February, 2002 and delay in filing Appeal was also condoned.
Considering the facts of the case, I am of the view that impugned order does not suffer from any error of law apparent on the face of record. However, as matter is pending before Consolidation Officer, Patiyali, District Etah, I direct Consolidation Officer concerned to decide dispute pending before him as early as possible preferably within six months' from the date of production of a certified copy of this order. The order of Appellate authority directing to lodge a F.I.R. and to initiate disciplinary proceeding against Assistant Consolidation Officer is maintained.
With above observations, writ petition is dismissed.
