The compliance of the order dated 9.3.2006 could not be made by learned Chief Judicial Magistrate on the ground that the accused appellant Rasul Khan did not reside on the address given in the memorandum of appeal. On the compare, the address of the appellant with that of given in his statement u/s 313 Cr.P.C. It indicates that the address given in the memorandum of appeal is wrong. The correct address of the appellant is Rasul Khan son of Nababu resident of Bisambhara, P.S.Shergarh, District Mathura. A copy of the order dated 9.3.2006 along with a copy of this order be sent again to the learned C.J.M. Mathura to comply the order dated 9.3.2006 on the address given above. The compliance report be submitted within two months.
Sri Virendra Saran counsel for the appellant has been elevated and retired from the bench of this Court. The appellant is therefore, desired to engage another counsel.
