Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that there is cross version of the alleged offence. From both the sides the F.I.Rs. have been registered . Both sider received injuries. From the side of the prosecution one person lost his life and one person received injuries. From the side of the applicant 3 persons have received injuries which have not been explained by the prosecution. The prosecution has not come with clean hands.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Bihari involved in Case Crime No. 93 of 2006, under Sections 147, 148, 323, 324, 426, 504,, 304 I.P.C. and Sections 3(ii)(v) of the SC/ST (P.A) Act, Police Station Ghughli Bujurg , District Mahrajganj be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
