Heard learned counsel for the appellant, Sri Anil Srivastava, learned counsel for the complainant, learned A.G.A. and perused the judgment under appeal.
Office is directed to summon the record within a period of four weeks.
It is contended on behalf of the appellant that appellant played no active role and he is said to have instigated his associates to kill Mahatma Dhar Dwivedi.
Having considered all facts and circumstances of the case, we are inclined to release the appellant on bail.
Let the appellant, Gauri Shanker Mishra be released on bail during pendency of the appeal in S.T. No. 116 of 2001 (State versus Gauri Shanker Mishra) on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of the C.J.M., Gorakhpur subject to his depositing the entire amount of fine in the court below within a period of six weeks from today.
The Chief Judicial Magistrate will send photocopies of the bail bonds to the Court immediately.
