In The Goods Of Late Ram Das - TESTAMENTARY SUITS No. 4 of 1999  RD-AH 8697 (1 May 2006)

By order dated 13.2.2004, this Court had stayed the proceedings of this Suit i.e. Testamentary Suit No. 4 of 1999 till the disposal of O.S. No. 246 of 1998 pending before Civil Judge (Junior Division), Basti and O.S. No. 277 of 1998 pending before Civil Judge (Senior Division) Basti.
In Special Appeal No. 243 of 2004 against the order between Smt. Ram Kali alia Ram Lali vs. Board of Revenue, the appellate court vide its order dated 24.3.2004 noticed that there was more Suits pending at Basti and while consolidating all the Suits, the orders staying the proceedings of this Suit was confirmed. The Suits pending at Basti are detailed as below;
1.O.S. No. 1 of 1976 filed by Dashrath panging in the Court of Civil Judge (Senior Division) Basti.
2.O.S. No. 356 of 1979 filed by Dashrath pending in the Court of Civil Judge (Junior Division) Basti
3.O.S. No. 157 of 1992 filed by Ram Das pending in the Court of Civil Judge (Senior Division) Basti.
4.O.S. No. 246 of 1998 filed by Ram Kali pending in the Court of Civil Judge (Junior Division).
5.O.S. 277 of 1998 filed by Ram Cali pending in the Court of Civil Judge (Senior Division) Basti.
This Testamentary Suit was filed in the year 1999 and is now awaiting the decision in aforesaid Suit consolidated by this Court.
Let the Registrar General of this court send instruction to District Judge, Basti to keep this Court informed with the progress of the five Suits quarterly basis. The first such information shall be sent on or before 15.7.2006.
The trial court is reminded that the Division Bench in Special Appeal No. 283 of 2004 by its order dated 24.3.2004 expedited the proceedings in five suits. It must endeavor to decide the suits without granting any frivolous adjournments. List in third week of July, 2006.
