None appears for the petitioner even on the revision of the list.
Learned A.G.A. And Sri Sunil Kumar Srivastava holding brief of Sri A.K. Upadhya have been heard.
The transfer application is moved solely on the ground that the petitioner apprehends danger to his person and life. The petitioner was also threatened for the same consequences to which his deceased daughter had met.
Considering the jurisdiction lies to the District Jaunpur I see no merit in the transfer application. But I do not deem it proper to quash the order that whenever issuing summon for the evidence of the petitioner Ram Krishna Tripathi or his family members, the Sessions Judge shall also pass an order for the security of the prosecution witnesses from the place of board of the prosecution witnesses to the Court situate at Jaunpur to the back. The S.P. Pratapgarh is also directed to provide adequate security to the prosecution witnesses, when the prosecution witnesses or the Presiding Officer to the court concerned request for such security.
With these direction the transfer application stands disposed of.
