Heard argument of learned counsel for the applicant and learned A.G.A.
It is contended on behalf of the applicant that he is not named in the F.I.R.. His role has been shown to surveillance of the kidnappee. It is further contended that bail application of the co-accused has already been allowed by this Court vide order dated 28.4.2006. It is further contended that kidnapee has not been recovered from his possession.
After considering the facts and circumstances of the case, the bail application is liable to be allowed on the ground of parity.
The bail application is allowed. Let applicant Anil involved in case Crime No.39 of 2006, under Section 364-A I.P.C., Police Station Chakeri, District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the concerned Court.
