Petitioner claims to be the wife of Late Lok Bahadur Gurung who was employed as Soldier in the Indian Army. Shri Lok Bahadur Gurung was summary court martialed and was sentenced to undergo imprisonment during this period Shri Lok Bahadur has expired. Petitioner for the purposes of availing pension and other monetary benefits moved an application under Section 164 of the Army Act for revocation of the punishment the petitioner imposed on her husband. The application has not been decided. Hence the present writ petition.
Without entering into the merits of the claim set up by the petitioner the present writ petition is disposed of with a direction to the concerned authority to decide the application of the petitioner in accordance with law by means of a reasoned speaking order, preferably within eight weeks from the date a certified copy of this order is filed before authority concerned.
