It appears that on the report of applicant a case under Section 304-B I.P.C was registered and the opposite party No.2 to 6 were chargesheeted. It is alleged that the trial proceeded in the court at Bulandshahr in which the applicant was witness. It is submitted that when the applicant attend the court and returned therefrom he was threatened. On 2.9.2005 some incident took place for which a complaint was sent to S.S.P. Bulandshahr. It is alleged that on 27.1.2006, when the date for hearing was fixed, the opposite parties again beat him and the injuries were examined. On both the occasion there is no F.I.R whereas the applicant is most important witness of the prosecution. It is duty of the prosecution and the district police chief at Bulandshahr to provide him protection while appearing on the date fixed. Thus, it is hereby directed that S.S.P. Bulandshahr shall provide complete protection to the applicant and his family member who are the witness in this case. Though it would be for the S.S.P. Bulandshahr to decide as to in what way he provide the protection but It would be just and expedient if he directs the concerned police station that the applicant or his family member when appears in the court for evidence, may be escorted by the police of that police station from the place of residence of witness to the court and then from the court to residence.
With this direction, the transfer application is disposed of finally.
