Heard Sri Manu Saxena learned counsel for the petitioners.
The main relief claimed is to issue a mandamus to command respondent no. 2 to decide the release application filed by the petitioners under Section 16(1)(b) of the U.P. Act No. 13 of 1972 within time specified by this Court.
A perusal of the order sheet filed as Annexure-3 to the writ petition goes to show that the said application was filed on 14.6.2005 and since then about 32 dates have been fixed. Rule 13(4) framed under the Act prescribed that every application filed for release under Section 16(1)(b) of the Act shall, as far as possible, be decided within one month from the date of its presentation.
Considering the aforesaid facts and circumstances, a mandamus is issued to respondent no. 2 to dispose of the application no. 7 of 2005 pending before him within a period of one month from the date of production of certified copy of this order before him.
With the aforesaid direction, the writ petition stands disposed of.
