The petitioner wants to withdraw the writ petition on the ground that the petitioner will make a fresh representation annexing the documents to the relevant authority for making the payment of family pension. As the respondents themselves vide letters dated 7.1.2000 and 10.10.2001 (Annexures 9 and 10 to the writ petition respectively) have stated that as the matter is 32 years old, therefore, there is no record in the office of the respondents to verify the facts relating to the working of the petitioner's husband in the workshop.
The writ petition is dismissed with liberty to the petitioner to make a representation annexing any document to show that the husband of the petitioner was an employee of the respondents and had died due to the accident in the year 1967. If such representation is filed by the petitioner, the same may be considered sympathetically according to law and the respondents if possible on the aforesaid basis, may consider the claim of the petitioner for payment of family pension. No order as to costs.
