This is an  application for bail moved on behalf of the applicant Riyazuddin                              indicted in case crime No. 1  of 2006 under section 302  I.P.C. P.S. Sunnagarhi District Etah.

Heard Shri Jai Narain, learned counsel for the applicant, Shri A. Kumar Singh, learned counsel for the complainant,   learned A.G.A.  and have perused the record.

      On 1.1.2006 at about 4 P.M. the informant's elder brother Baquar Ali alias Vakarua was subjected to murderous assault. The eye witnesses Younis, Israil and Rajendra in their statements recorded under section 161 Cr.P.C.  have assigned the role of opening fire at the victim to the co-accused Ramjani. The postmortem certificate indicates the presence of three incised wounds on the person of the deceased besides two exit wounds. The applicant is said to have subjected the victim to assault. No other injuries except the injuries caused by fire arm have been found on the person of the deceased.

      In view these facts and circumstances, I consider it to be a fit case for grant of bail.

Let the applicant Riyazuddin                              indicted in case crime No. 1 of 2006 under section 302 I.P.C. P.S. Sunnagarhi District Etah be enlarged on bail on furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
