Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The alleged occurrence had taken place on 13.9.2005, but on 25.2.2006 the recovery of a stolen motorcycle was shown from the joint possession of the applicant and other co-accused. The applicant is in jail since 25.2.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and learned A.G.A. and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Munna Lal involved in Case Crime No. 451-D/2005 , under Section 379/411 I.P.C., Police Station Civil Lines, District Aligarh be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
