Inspite of awaiting for a considerable period, none appeared on behalf of the State.
Heard learned counsel for the applicant and perused the record.
The co-accused Chhedi has already been released on bail by this Court vide order dated 27.4.2006. A plain perusal of the F.I.R reveals that the co-accused Chhedi and Rajesh had made fire from the country made pistal on the deceased.
In such circumstances, the applicant is entitled for bail.
Let the applicant Shri Raju Harizan son of Ram Badan be released on bail in Case Crime No. 104 of 2004 under Sections 394, 411, 302 I.P.C., Police Station Phoolpur, district Varanasi on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
Let a copy of this order be sent to Home Secretary, Govt. Of U.P. Lucknow, for information.
