It is unfortunate that appeal No. 70 of 1994 is pending for 12 years even though matter arises out of release proceedings under section 21 of U.P Act No.13 of 1972 on the ground of bonafide need. At present the appeal is pending before A.D.J Court No.2 Mathura.
Appellate court is directed to positively decide the appeal within three months from the date of production of certified copy of this order failing which matter may be referred on the administrative side before the Hon'ble Administrative Judge in charge of the district in question. If on the next date any adjournment in any form is sought by the tenant then stay of eviction which has been granted to him by the appellate court shall be made conditional and tenant's dispossession shall be stayed only on the condition of payment of Rs.2000/- per month as rent/ damages for use and occupation in view of Supreme Court Authority reported in Atma Ram Properties Versus Federal Motors 2005 (1) SCC 705.
With the above observations writ petition is disposed of.
