I have heard Sri S.N. Tiwari, counsel for the petitioner and Sri M.P.S. Niranjan who appears for the Mandi Parishad.
The petitioner is aggrieved by the order passed by the Director, Mandi Parishad dated 15.11.2003. It has been brought to the notice of the Court that the petitioner has a remedy by way of filing a detailed representation before the Director bringing out the Government Order of 1973 correctly.
In view of the aforesaid fact the present writ petition is disposed of finally with an observation that if the petitioner files a detailed and comprehensive representation annexing the copy of the Government Order before the Director, Krishi Utpadan Mandi Samiti within three weeks, the Director concerned will decide the same on merit and will pass an appropriate detailed and reasoned order according to law preferably within three months from the date of production of a certified copy of this order before him. It is made clear that while passing the order on the representation of the petitioner, the order-dated 15.11.2003 may not be taken into consideration to reject the claim of the petitioner. No order as to costs.
