Proceedings under Section 34 of the U.P. Land Revenue Act were pending before the Naib Tehsildar, Achhalda, Auraiya. A transfer application was filed by Smt. Jaydevi Pandey stating therein that she is a lady and the petitioner is an influential political person and when she came to Bidhuna for doing pairvi of the case she saw that the petitioner coming out from the house of the Naib Tehsildar. The Board of Revenue has allowed the transfer application. Learned counsel for the petitioner submitted that the husband of the opposite party is a lawyer in Kanpur and the transfer has been made to the court of Tehsildar Bilhor, Kanpur and therefore the petitioner will not get justice. It is conceded by the learned counsel for the petitioner that the husband of the petitioner is practicing in the civil court. The transfer has been made to the revenue Court of Tehsildar, Bilhor, Kanpur Nagar. Assuming that the husband is a lawyer it cannot be presumed that he has influence over the court. Dismissed.
