This petition has been filed against an order-dated 27.2.2006 of the Assistant Collector directing the eviction of the petitioner and also imposing damages. It is stated in the impugned order that the petitioner refused to accept the notice. According to the learned counsel for the petitioner no notice was served upon the petitioner and the order is ex parte one. If the petitioner was not served the petitioner has alternative remedy of filing a revision, or an application for setting aside the order dated 27.2.2006 before the Assistant Collector, Modi Nagar, Ghaziabad himself.
Learned counsel for the petitioner states that the petitioner will file such an application. In case such an application is filed the Assistant Collector shall try to dispose it of expeditiously and if possible within a period of one month from the date a certified copy of this order is filed by the petitioner before him. It is made clear that no opinion upon the merits of the petitioner's case as to whether he was served or not is being expressed by this Court and it is for the Assistant Collector to consider the case in accordance with law.
With the above directions the writ petition is disposed of finally.
