Ram Kumar v. District Magistrate, District Rampur And Another - WRIT - C No. 25455 of 2006 RD-AH 9238 (9 May 2006)
Hon'ble Yatindra Singh,J.
The petitioner's fair price shop licence was given suspended on 24.11.2005. He filed a writ petition against the same, which was disposed of on 14.2.2006 keeping the suspension order in abeyance till disposal of the representation, but he was not given supply of the essential commodities. Hence, he has filed the present writ petition.
We have heard counsel for the petitioner and the Standing Counsel for the respondents.
In the circumstances of the case, it would be appropriate that the petitioner may file a fresh representation before respondent no. 2. In case the representation is filed, it may be decided by the said respondent by a reasoned order at an early date, if possible, within one month from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioner.
With these observations, the writ petition is disposed of.
