We are in respectful agreement with the reasoning given and the order passed by Hon'ble Mr. Justice A.P. Sahi on 6.4.2006.
The interim order passed by the same Hon'ble Judge dated 7.12.2005, at page 74 of the paper book before us, shows that his Lordship was considering the matter with the utmost sympathy for the appellants-writ petitioners from the very beginning.
However, the fixation of the upper age limit by the Government Order with a possible relaxation up to five years, could not be even further relaxed by his Lordship and as such the impugned order, with respect, is perfectly sound and legal.
On behalf of the appellants-writ petitioners it was submitted that certain beneficial orders have been obtained by them, or others in similar situation, earlier; as a sample, as order dated 17.8.1999, at pages 52-53 of the paper book is placed before us. The submission was that contempt applications in regard to those orders are still pending. We make it clear that the dismissal of this appeal will not, in any manner, prejudice those applications.
Save for the above clarification, the appeal is dismissed.
