This petition has been filed for quashing the order dated 3.4.2006 passed by the Tehsildar, Nizamabad, Tehsil and District Azamgarh whereby the Income Certificate earlier granted to the petitioner has been cancelled. A further direction has also been sought that the application dated 10.4.2006 submitted by the petitioner before the District Magistrate, Azamgarh against the aforesaid order, which is pending disposal, be decided by respondent No.2.
We have heard the learned counsel for the petitioner and the learned Standing Counsel appearing for respondent Nos. 1 to 3. In view of the order that we propose to pass, it is not necessary to issue notice to respondent No.4.
Learned Standing Counsel has suggested that instead of deciding the petition on merits, the District Magistrate, Azamgarh may be requested to decide the pending application filed by the petitioner against the aforesaid order after hearing the petitioner and respondent No.4.
In view of the aforesaid submissions of the learned Standing Counsel, we dispose of this petition requesting the District Magistrate, Azamgarh to decide the pending application dated 10.4.2006 (Annexure ''5' to the writ petition) after hearing the petitioner and the private respondent No.4 expeditiously and giving them opportunity to lead their evidence preferably within a period of four weeks from the date a certified copy of this order is produced by the petitioner before the District Magistrate, Azamgarh.
