During the course of arguments Shri A.K. Mehrotra, learned counsel for the respondents, on instruction from Mr. H.K. Agarwal, Company Secretary of the U.P. Rajya Vidyut Utpadan Nigam Limited, states that after issuance of the U.P. Rajya Vidyut Utpadan Nigam Limited, Absorption Regulation - 2006, contained in Annexure 12 to the writ petition no.14670 of 2006, this writ petition has become infructuous, as the orders impugned in this petition, contained in annexures 10 & 11, have become redundant and the employees will now be governed by the new regulations. Similar stand has been taken in the counter affidavit also filed on behalf of respondent no.5.
Shri Ashok Khare, learned Senior Counsel states that after issuance of new regulation, if these orders are not to be implemented, the cause of action does not survive.
In view of the above, since the cause of action does not survive, this writ petition has become infructuous. It is accordingly dismissed.
