This petition has been filed for quashing the order dated 9.6.2005 passed by the Principal Secretary, Panchayati Raj, Government of U.P. and for a direction upon the respondents to constitute a separate Gram Sabha of village Udaipur from the Gram Sabha Kalakhuri as the village Udaipur has the population over 1000 and satisfies with all legal requirements.
The petitioner had earlier approached this Court by filing Writ Petition No. 25166 of 2005 which was disposed of by us by the order dated 1.4.2005 by directing that the representation filed by the petitioner for constituting a separate Gram Sabha shall be disposed of in accordance with law. The representation was ultimately decided against the petitioner by the Principal Secretary by means of the order dated 9.6.2005 which has been impugned in the present petition.
This petition is highly belated and no satisfactory explanation has been furnished in the petition for explaining the delay in filing this petition. It is, therefore, likely to be dismissed on this ground. This apart, we are of the opinion that the order impugned cannot be said to suffer from any infirmity as valid and cogent reasons have been given in the said order. In any view of the matter, it is not a fit case for interference under Article 226 of the Constitution.
The writ petition is, accordingly, dismissed.
