This is an  application for bail moved on behalf of the applicant Chunna Kori alias Chunkauna    indicted in case crime No. 23 of 2006 under sections 386, 323, 506 I.P.C. and 10/14 of  Dacioty Affected Area P.S. Pahari District Chitrakoot.

Heard Shri A.K Singh, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The applicant and three co-accused are said to have threatened to kill the complainant if their demand of Rs. one lakh was not satisfied. The applicant was arrested in police encounter case on 17.3 2006.

The learned counsel for the applicant submitted that applicant belongs to the same village in which the incident is said to have taken place. The learned counsel pointed out that applicant has been falsely implicated due to party faction. The contention of the learned counsel was that offences are triable by the Magistrate Ist class.

Having taken into consideration these facts and without commenting on the merits of the case, I find it to be a fit case to release the applicant on bail.

Let the applicant Chunna Kori alias Chunkauna    indicted in case crime No. 23 of 2006 under sections 386, 323, 506 I.P.C. and 10/14 of  Dacioty Affected Area P.S. Pahari District Chitrakoot. be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
