The counsel for the petitioner submits that last date for filing application along with functional certificate for consideration in the scheme was 21.4.2006. The petitioner had applied for functional certificate on 1.3.2006 but it was given to him on 24.4.2006 by the NOIDA and as such delay, if any, is on the part of the NOIDA and the petitioner should be considered in the scheme.

Issue notice.

Notice on behalf of respondents no. 1 and 4 has been accepted by Sri V.P. Mathur. Notice on behalf of respondents no. 2 and 3 has been accepted by the Standing Counsel. They pray for and are granted a month's time to file counter affidavit and three weeks thereafter are allowed to file rejoinder affidavit.

List this petition for admission in the month of July, 2006.

In the meantime, NOIDA will consider name of the petitioner in the scheme. However, this consideration in the scheme will be subject to the final decision of the writ petition.
