This is an application for bail moved on behalf of the applicant Prithvi Singh indicted in case crime No. 215 of 2006 under section 2/3 of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 P.S. Kotwali District Mainpuri.
Heard Shri Saurabh Tiwari, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that in the gang chart criminal history of four cases has been mentioned out of which applicant is on bail in three cases and in case crime no. 146 of 2006 his arrest has been stayed by an order dated 22.3 2006 passed by this court in Criminal Misc. Writ Petition No. 3057 of 2006.
The learned A.G.A. submitted that the applicant is involved in four criminal cases and in case he is released on bail he may commit some other offence.
Having taken into consideration the submissions raised on behalf of both the parties, the applicant being on bail in three cases and in case crime no. 146 of 2006 his arrest having been stayed, I consider it to be a fit case for bail.
Let the applicant Prithvi Singh indicted in case crime No. 215 of 2006 under section 2/3 of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 P.S. Kotwali District Mainpuri be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction the court concerned.
