Heard learned counsel for the petitioner.
The petitioner's application for extending the stay order passed by the appellate court was rejected by the impugned order dated 31.8.2005. The parties had moved before the appellate court stating that they had been negotiating for a compromise and in those circumstances the appellate court did not find it proper to extend the stay order and by the said impugned order (31.8.2005) that prayer of the petitioner for such extension was refused. I do not find any justification to interfere in such order in the writ jurisdiction. The appeal is still pending. The petitioner may negotiate for compromise with the respondents or may get his appeal expedited and disposed of . If the court is vacant where the appeal is pending, an application for transfer of the appeal to some other court may be moved to the District Judge.
In view of the aforesaid, the petition is hereby dismissed.
