Learned counsel for the appellant elevated to  the Bench and has since expired.

Notices sent to the appellant to engage another counsel on 3.12.2004 fixing 10.1.2005 have ot been received back either delivered or undelivered.  The office report dated 25.11.2004 shows that both appellants were unserved as they have died.  

This Court has taken sufficient care to inform the appellants, which is otherwise the duty of the counsel who is elevated.

No one represents the appellant for more than ten years .  The second appeal is accordingly dismissed for want of prosecution.
