Basant Kumar Singh v. State Of U.P. Thru' Secy. Home & Others - WRIT - C No. 43328 of 2005 RD-AH 9581 (16 May 2006)
Civil Misc. Writ Petition No.43328 of 2005
Basant Kumar Singh Vs. State of U.P. and others
Hon'ble V.C. Misra, J.
Heard Sri S.P. Singh learned counsel for the petitioner and learned standing counsel at length and perused the impugned award.
The grievance of the petitioner is that his license has been cancelled on the ground that at the time when he applied for the same he concealed the material fact that he had been found involved in a criminal case and first information report was lodged in the proceedings initiated against him under the provisions of Sections 147,148,323 and 307 of the Indian Penal Code.
I find that this very specific fact has not been denied that the pendency of the case was not disclosed in the application by the petitioner at the time when he applied for procurement of the license which is an essential ingredient of the application form. I do not find any illegality or irregularity in the impugned order. No other valid ground has been disclosed in support of the writ petition. The writ petition is accordingly dismissed. No order as to costs.
