Dinesh Kumar v. State Of U.P. & Others - SPECIAL APPEAL No. 505 of 2006 RD-AH 9598 (16 May 2006)
Special Appeal No. 505 of 2006
State of U.P. & Ors.
Hon'ble Dr. B.S. Chauhan, J.
Hon'ble Dilip Gupta, J.
This special appeal has been filed against the judgment and order dated 10.04.2006 passed in Civil Misc. Writ Petition No.19622 of 2006 by the learned Single Judge.
The contention of the learned counsel for the appellant is that the appellant had been placed at serial no.2 in the select list prepared for the post of the Shiksha Mitra, but she has not been sent for training. The petitioner-appellant has filed a representation before the District Magistrate, Allahabad but the same has not yet been decided. The inaction on the part of the District Magistrate in not deciding the representation of the appellant is causing great prejudice to the appellant inasmuch as the training has already started.
Learned Standing Counsel appearing for the respondents has submitted that the District Magistrate shall look into the representation filed by the appellant and pass an appropriate order in accordance with law.
In view of the above, we dispose of this special appeal with a direction that the District Magistrate, Allahabad shall pass an appropriate order on the representation filed by the appellant expeditiously, preferably within a period of three weeks from the date of filing a certified copy of this order before him, after hearing the appellant and other interested persons.
