We have heard counsel for the petitioner and the Standing Counsel for the respondents.
The petitioner is permitted to implead the Sub Divisional Magistrate, Khalilabad district Sant Kabir Nagar as respondent no.4.
According to the petitioner he is a fair price shop licensee. His shop was attached with the respondent no.3 on his own application due to ill health. The petitioner recovered in March, 1997 and he submitted numerous applications before respondent no.4 praying for restoring the shop back and lastly he filed an application dated 14.2.2006 before the said authority in this regard. As it has not been decided, he has filed the present writ petition.
In the circumstances of the case it would be appropriate that the petitioner's application dated 14.2.2006 may be decided by the concerned authority by a reasoned order at an early date, and if possible, within three months from the date of receipt of certified copy of this order. He shall also provide an opportunity of hearing to respondent no.3. The petitioner along with certified copy of this order will also file a copy of his aforesaid application, other necessary documents and a duly stamped self addressed envelope. The concerned respondent after taking decision will communicate the same to the petitioner.
With these observations the writ petition is disposed of.
