The grievance of the petitioner as represented by his counsel Sri Ashutosh Tripathi is that an order has been passed by the Additional Commissioner dated 21.11.2005 allowing the revision of the petitioner and directing that the land of Plot No. 99/1.607 be entered as non-agricultural land under Section 143 of U.P. Zamindari Abolition and Land Reforms Act subject to the rules/byelaws relating to building construction of the Ghaziabad Development Authority and Nagar Nigam, Ghaziabad, but the order of the commissioner is not being implemented although an application dated 17.2.2006 has been filed by the petitioner before the Up Zila Adhiakri, Ghaziabad.
I have heard the learned counsel for the petitioner, the learned Standing Counsel who represents respondents 1 and 2, Sri Ashwini Mishra, learned counsel for the Ghaziabad Development Authority, Ghaziabad and Sri Prem Chandra, learned counsel for the Nagar Nigam, Ghaziabad.
Without expressing any opinion upon the merits of the petitioner's case the writ petition is disposed of with a direction to the Sub Divisional Magistrate; Ghaziabad to pass appropriate orders on the representation filed by the petitioner expeditiously in accordance with law and if possible within a period of six weeks from the date a certified copy of this order is filed by the petitioner before him.
